These Terms of Service ("Terms") govern your use of AccessibilityPreCheck, an automated accessibility audit tool operated by AI Launch Pods. By using the service, you agree to these Terms.

What AccessibilityPreCheck Is — And Isn't

What it is

AccessibilityPreCheck is an automated, AI-powered accessibility audit tool. It identifies potential WCAG conformance issues based on automated analysis of web pages and PDF documents. Results are generated by software and may contain false positives or miss issues that require human expert review.

What it isn't

This tool does not constitute legal advice, professional accessibility certification, or manual expert audit. It is not a substitute for engagement with a qualified accessibility consultant or attorney. Compliance with the Americans with Disabilities Act, WCAG, any other accessibility standard, or any settlement terms is the responsibility of the website or document owner and their counsel.

No warranty

We make no warranty, express or implied, regarding the accuracy, completeness, or fitness for any particular purpose of audit results. Use of this tool, including in connection with settlement agreements, demand letter responses, or any litigation context, is at your own risk. AccessibilityPreCheck's liability is limited to the amount you paid for the specific audit at issue.

Acceptable Use

You agree to use AccessibilityPreCheck only for legitimate accessibility assessment purposes. You agree not to:

• Submit URLs you do not have authorization to scan
• Use the service to harass, defame, or harm any third party
• Attempt to overload, disable, or interfere with the service
• Resell or sublicense audit results without our written permission
• Use automated means to abuse free-tier rate limits

Pricing and Payment

The free summary scan is provided at no cost subject to rate limits. The full audit is $500 per check. Audits run through an attorney portal code may be billed at a different price set by the attorney. All payments are processed through Stripe.

Refunds

Audit fees are non-refundable once the audit has been completed and the report delivered. If an audit fails to complete due to a technical issue on our end, we will either re-run the audit at no additional charge or issue a refund at our discretion. Audits initiated via attorney-issued codes in connection with settlement agreements are non-refundable.

Intellectual Property

The AccessibilityPreCheck software, scanning methodology, and report templates are the property of AI Launch Pods. The content of your scanned websites and documents remains your property. Audit reports generated for you are yours to use, share, or incorporate into compliance documentation.

Termination

We may suspend or terminate access to the service for violations of these Terms. You may discontinue use at any time. Termination does not affect any rights or obligations that arose before termination.

Limitation of Liability

To the maximum extent permitted by law, AI Launch Pods and AccessibilityPreCheck shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from your use of the service. Our total liability for any claim is limited to the amount you paid for the specific audit giving rise to the claim.

Changes to These Terms

We may update these Terms from time to time. Material changes will be reflected by an updated effective date at the top of this page. Continued use of the service after changes constitutes acceptance of the updated Terms.
